Terms and Conditions of Hire

TERMS & CONDITIONS OF EBIKE HIRE

These Terms and Conditions are governed by the Laws of New Zealand.

An agreement made between Hahei eBike Hire, trading as Hahei Holidays Ltd, and the hirer whose details are entered overleaf.  Hahei eBike Hire requires the hirer to read the full Terms and Conditions carefully before signing the Waiver and Release Agreement . The hirer by their signature accepts and agrees to the full Terms and Conditions.

1. RETURNS

a) The Hirer agrees to return the bike to Hahei eBike Hire at the agreed return time. A late return may be charged at the rate of a new hire.

b) The Hirer agrees to return the bike in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. The Hirer accepts use of the equipment AS IS, in good condition, and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the discretion of Hahei eBikes. The Hirer agrees to pay current market repair or replacement costs and retail prices for components replaced. (Undamaged condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes.)

2. LOST OR DAMAGED ITEMS

a) We reserve the right to charge the replacement value of any item that is not returned or goes missing.

b) We reserve the right to charge for damages at our discretion, up to replacement value. Undamaged condition is described in clause 1b above. The Hirer agrees to indemnify Hahei eBike Hire for any property damage caused intentionally or negligently while using the e-bikes, and whether to the e-bikes or to property of any third party.

c) Our eBikes are maintained on a daily basis. It is the responsibility of the customer to check the eBike at the start of the hire and familiarising themselves with the functions BEFORE departing on the hire.

3. CANCELLATIONS

a) Bookings cancelled 24 hours before hire – 100% refund. Bookings cancelled less than 24 hours before hire – No refund. There are no refunds for early returns.

BICYCLE/EQUIPMENT TERMS OF USE

The Hirer agrees to treat the eBike and other equipment with reasonable care including:

• Always locking the bicycle securely (e.g. Bike stand, pole or tree) if leaving unattended. Bike locks are provided.

• Helmets and high visibility vests are included in the rental. It is compulsory to wear a helmet according to New Zealand Law.

• The weight limit per bike is 120kg, no exceptions as this is necessary for compliance with our eBike warranty conditions. 

• Our eBikes are powerful. Anyone hiring or riding one MUST be 18 years or over, or be riding with their parents or guardians.

• Familiarise yourself with your eBike BEFORE getting up to speed. The larger bikes can go up to and over 40Kms phr. They are not toys and need to be respected on our busy rural roads.

• Despite their appearance, our eBikes are not mountain bikes and do not belong off-road. They must NOT be ridden in sand, on the beach or in any water. If evidence of this occurrence is suspected, a minimum cleaning charge of $35.00/eBike will apply, plus payment for any repairs due to misuse.

• We strongly encourage Hirers to stay OFF the main State Highway 25 due to high traffic volumes and logging truck usage. Whitianga can be safely accessed via the passenger ferry at Ferry Landing.

• Always wear the safety equipment provided and keep to the LEFT hand side of the road. Obey ALL New Zealand Road Rules and traffic laws.

• Observe safe riding practices, always riding with caution and consideration of other road users. Do NOT ride side by side.

• To protect future hirers, please notify us immediately of any accident, incident, or damage.

The Hirer agrees to provide Hahei eBike Hire, trading as Hahei Holidays Ltd, with credit card details, for precautionary use only: 

• •  The Hirer authorises Hahei eBike Hire to charge the credit card they have on file for you for all eventual costs in case of loss or damages to the bicycle(s) during your rental period, comprehensive of labour.

  • In case of theft, The Hirer will be responsible for reimbursing Hahei eBike Hire for the replacement price of the bicycle(s), plus the cost of any accessories that were provided at the time of the bike rental.

NOTE: The above requirements are contractual terms that must be complied with by the hirer. Hahei eBike Hire reserves the right to refuse hire for not correctly executing this document, or at their discretion.
